In 2012, the Uniform Law Conference of Canada published the Uniform Trustee Act and recommended it be adopted by the common law provinces. ALRI representatives participated in the creation of the Uniform Trustee Act.
ALRI’s Report For Discussion #28, A New Trustee Act for Alberta, consists of recommendations for implementing the Uniform Trustee Act in Alberta. Using the Uniform Trustee Act as a starting point, ALRI has enhanced, tailored and clarified the Uniform Trustee Act to ensure Alberta’s trustee legislation reflects Alberta’s law and practice and meets the needs of Albertans.
Throughout this project, ALRI has been guided by an intention to make Alberta’s trustee legislation modern, certain, useful, and clear. Please review our report and provide your feedback on our recommendations. Many of the highlights of the report are specifically addressed in the following surveys:
- Advancement
- Non-Charitable Purpose Trusts
- Trustee Compensation
- Trustee Powers and Duties
- Variations – Court Approved on Behalf of Beneficiaries
- Variations – How Should Trusts be Varied or Terminated?
Please provide all feedback by April 30, 2016.
ALRI is conducting this consultation in collaboration with Alberta Justice and Solicitor General (JSG). All responses will be shared between ALRI and JSG. You may also provide comments to JSG directly.
